Did you hear?… Caddell & Chapman files class action complaint against SIGG

SNEWS® has obtained a copy of a class action complaint filed on Aug. 28 in the United States District Court, Western District of Kentucky, against SIGG. The complaint, brought by Caddell & Chapman of Houston, Texas, seeks “to represent a nationwide class of consumers who purchased SIGG reusable aluminum bottles that unbeknownst to them contain BPA” and alleges that the plaintiffs and the class they represent “paid more for SIGG bottles than other available alternatives because they believed SIGG’s representations that their bottles were BPA-free.”

The named plaintiffs, Allison Johnson and Melissa Tantibanchachai are seeking damages for breach of contract, breach of warranties and violations of the Kentucky Consumer Protection Act.

SNEWS® View: Quick legal 101…this is simply a complaint. The next step will be for SIGG to answer the complaint. Then, at some point, perhaps as long as four to six months, the attorneys for the plaintiffs will file a motion for class certification with the court and, naturally, SIGG’s legal team will file a brief in opposition of the class action. Whether or not it becomes a class action is entirely left up to the court. Of course, it is also possible that this could get settled long before then, too. We’ll keep you posted. –SNEWS® Editors
