In a hearing before the U.S. Bankruptcy Court, Northern District of Texas, the date for a final hearing to confirm the reorganization plan filed by Keys in July was set for Sept. 3.

Votes by creditors on the plan must be submitted to the court by Aug. 29, with the last day to object to the plan set for Aug. 26. The hearing will be held before Judge Harlin D. Hale, at the courthouse at 1100 Commerce St., on the 14th floor, in Dallas, Texas.
Keys, which would be after confirmation known as “reorganized fitness,” since the case combined both Keys Fitness and Keys Backyard, may not now alter any part of the statements or plans filed with the court.
In a small wrinkle, on July 30, Icon Health & Fitness filed for clarification on non-applicability of the automatic stay since it filed an infringement suit against Keys in 2006 before bankruptcy proceedings began. A hearing on that request is set for Aug. 25.
