Did you hear?… Lime Pro files for extension in Icon infringement suit

Lime Pro Equipment has filed for an extension from Aug. 1 to Aug. 15 for the required filing of an opposition to Icon’s request for a preliminary injunction in the suit Icon filed against Lime Pro in mid-July.

The court has set a status report meeting on Aug 13 in the U.S. District Court, Utah, on the case that charges Lime Pro with producing and selling equipment that has copied Icon brand NordicTrack’s look and feel in a manner that is confusing to the consumer. Since the products are also now for sale by the Mexico-based company with a San Diego office with an eBay store, Icon is also charging trade dress infringement.

Although an infringement case is not unusual for the fitness industry, the case has wrinkles that include a former long-time Icon distributor heading the Lime Pro company and PhotoShop-manipulated office pictures on the Lime Pro website (www.limeproequipment.com).

In support of the Lime Pro motion for an extension, the company said in the Aug. 6 filing it was “only recently” served with the copies of the complaint “and, as such, have not had the opportunity to fully evaluate their defenses.”
