Perfect Pushup Prevails In Action Against Ebay Sellers

Perfect Pushup LLC, designer and distributor of the well-known Perfect Pushup fitness solution (www.perfectpushup.com), today announced that Federal Court Judge Howard Matz of Los Angeles granted a permanent injunction against sellers of counterfeit Perfect Pushup merchandise on eBay. The court order prohibits the named defendants from selling any products that violate Perfect Pushup’s intellectual property rights, under the threat of being held in contempt of court. The defendants agreed to pay an undisclosed financial settlement.

“Perfect Pushup, like other successful product manufacturers and retailers in the United States, has recently been faced with the reality of unauthorized sales of inferior counterfeit products on the Internet,” said founder and former Navy SEAL, Alden Mills. “Perfect Pushup will not tolerate this kind of business behavior. We are committed to eradicating all counterfeit sales on the Internet. Our customers only deserve the best quality products and they are the ones who are victimized when fakes are sold as genuine products.”

Joseph P. Costa, of Costa Abrams & Coate, LLP, an attorney for Perfect Pushup, said “Perfect Pushup is extremely aggressive about going after sellers of infringing product. If you do it, they are going to come after you. Apparently, the defendants in the action claimed that they were not aware that the product they purchased and sold on eBay was counterfeit; however, information revealed that the products were being purchased directly from China and accordingly, that the sellers should have known that if you are buying directly from sources in China, it is almost certainly counterfeit.”
